FIN 4385-01 Case II: Executive Summary For the past several weeks, BJSMC conducted a comprehensive estate plan providing a structural outline of our client’s, Scott, estate opportunities and limitations subject to specific request. Our client provided us with the following scenarios: 1). If Scott dies this year, predeceasing Sue, and his executor elected his date of death as the valuation date, indicate those assets (and their values) that would be includible in Scott’s gross estate for estate tax purposes.Also, please explain your reason for the inclusion or exclusion of each asset. 2). Based on Scott’s current estate plan, indicate those assets and their values that would qualify for marital deduction. Explain your reasons for the qualification or non-qualification of each asset for the marital deduction. Based on factual information, hard-copy documentation, and professional experience, BJSMC established the following resolutions to scenario I: The â€Å"Catc hall Provision† of Internal Revenue Coded states the general rule that the gross estate includes the value of all property interests, real or personal, tangible or intangible. Under Section 2033, the decedent’s estate includes any interest in real estate, cash or money equivalents, whether kept in a bank, savings or checking account, certificates of deposit, money market funds, or a safe-deposit box. The gross estate also includes any stocks, bonds (including tax-exempt bonds), notes and mortgages owned by the decedent.Therefore, the full values of the following assets are included in Scott’s gross estate under IRC Sec. 2033 since he is the sole owner: o Stock in XYZ Corporation (500 shares) o Other listed common stock o Tax-free municipal bonds o Savings accounts o Household and other tangible personal property †¢ Section 2033 may also apply to inclusion of life insurance. If a decedent owns a life insurance policy on his or her own life at the date of deat h, the face amount of that policy must be included in the gross estate pursuant to Section 2042(2).This section establishes a standard regarding incident of ownership whereby the owner of a life policy is required to include the proceeds in the gross estate in the event that he or she possessed any incidents of ownership. In this case, it is specifically mentioned that Scott owns four life insurance policies on his own life. Therefore, the following items are included in Scott’s gross estate under IRC Section 2040: o Ordinary life policy purchased at age 23 o 20 – payment life policy purchased at 34 Ordinary life policy purchased at age 37 o Term to 65 policy purchased at age 44 †¢ Under IRC Section 2039, the total value of the profit-sharing plan and death benefit plan would be included in Scott’s gross estate. o XYZ Corporation – pension (noncontributory) death benefits o XYZ Corporation – profit sharing (noncontributory) death benefits â₠¬ ¢ A special rule was enacted to control the estate taxation of joint property with right of survivorship held solely by husband and wife as well as property held as tenants by the entirety.Section 2040(b) (1) pertains to the one-half inclusion rule for spouses. The rule is that one-half the value of such property, regardless of which spouse furnished all or part of the consideration, is included in the gross estate of the first spouse to die. Therefore, half the values of the following assets are included in Scott’s gross estate: o Residence purchased in 1987 o Vacation home o Checking account †¢ All property held in joint tenancy with right of survivorship by joint tenants other than a husband and wife alone is treated under a different rule.The property is included in a deceased joint tenant’s estate according to a percentage-of-contribution rule. Scott and Dan own the following property equally as tenants in common; therefore, half the value of the listed pro perty will be included in Scott’s gross estate: o Undeveloped real estate †¢ The property that Sue solely owns in her name (Saving account & other personal property) will not be included in Scott’s gross estate. Property and property interests that are includible under Section 2033 are those that are â€Å"owned† by the decedent.Scott doesn’t have any rights of ownership to Sue’s property in her name. In the novel, Out of the dust, Billie Joe experiences conflict with herself, her environment, and others. Additionally, she has great conflicts with her dad. They secretly blame each other wanting the other to know they accidently killed the mom. Billie Joe also has to deal with the dust. The dust kills families and destroys homes. Futhermore, she also has a conflict with herself. She knows she accidently killed her mom, but despite tragedies and conflicts Billie Joe knows that her family loves her and they forgive her by coming together to help each other live in peace. Billie Joe works against herself by blaming and limiting herself. For example, she stops trying to heal her hands. She has an amazing talent of playing the piano, but since she suffered burns on her hands, she limits herself by not practicing. Without her mother’s support, Billie Joe can barely go on in life without thinking of her mother’s death. Billie Joe still has her dad but both stay stuck in the horrible past. She and her dad both move on knowing they love each other and that they can help one another get through the horrible times. Billie Joe encounters nature in a horrible way. He dust causes huge problems for the people living in Oklahoma and all the dust bowl states. The dust comes in as thick clouds, burying houses and sickening families. Billie Joe cannot wait to leave her town along with other families wanting to escape from the dust and drought. She makes a decision to leave Oklahoma on a train. After Billie Joe arrives in California she realizes that the dust defines her and she can’t leave her dad at home to live by himself. In the novel, Out of the Dust, Billie Joe finds herself battling for a relationship with her father. Billie Joe and her father both know they have a part in the mother’s death. They both secretly blame each other wanting the other to have the guilt instead. In the end, Billie Joe and her father come together knowing the both love each other and they can’t afford to lose each other. In the end, Billie Joe still experiences conflicts with herself, her environment, and others. As she goes on in the book, she finds that if she comes together with her father they can help each other move on from the tragedy. As the dust comes into her town, Billie Joe struggles to live her everyday life. She then runs away but decides that the dust defines her and she must go back. Billie Joe then has to deal with not blaming herself about her mother’s death. Billie Joe figures out that if she ultimately accepts her family, she can defeat any battle thrown her way.

When the Civil War started in the year 1861, Douglass perceived it as a moral crusade to create a true democracy by freeing slaves. Throughout the course of the war, Douglass traveled across the country requesting President Lincoln to put an end to slavery and enroll black troops into the war effort. Douglas played a pivotal role in the recruitment of black soldiers into the Union Army after President Lincoln issued the Emancipation Proclamation in 1863. Since then, Douglas became Lincoln’s advisor throughout the Civil War. Douglass advocated for constitutional revisions, which would outlaw slavery and allow blacks a legally provided place in the American society. The 13th Constitutional Amendment illegalized slavery while the 14th Constitutional Amendment provided citizenship rights to all persons born in the US, and the 15th Amendment permitted voting to males aged over 21 years. In this activity, the yeast cells use fermentation(also known as anaerobic respiration) to transform the sugars in grape juice into carbon dioxide gas, ATP molecules, and ethanol. The yeast will become active in 15 to 20 min. GLX Setup Stop recording temperature data. Remove the Fast-Response Temperature Probe from the GLX. Connect a PASPORT Extension Cable into Port 1 on the top of the Xplorer GLX. Connect the other end of the Extension Cable to the PASPORT CO2 Sensor. The Graph Screen will automatically open with CO2 Concentration (ppm) versus Time (s). Open the GLX setup file labeled grape juice.glx (check the appendix at the end of this activity). The file is set to record data once per second. Sensor Calibration (Optional) See the appendix at the end of this activity. Equipment Setup Transfer 150 ml of warmed grape juice to the sampling bottle. Add a stir bar. Mix the yeast suspension well and add 10 mL to the juice. Use a dropper to add a layer of mineral oil to the surface of the grape juice/yeast mixture so the yeast will have anaerobic conditions. Put the end of the CO2 Gas Sensor into the sampling bottle loosely. (You do not want gas pressure to build up too high in the sampling bottle.) Do not push the rubber stopper down into the end of the sampling bottle. Note: Avoid bumping the CO2 Gas Sensor during data collection because it may record erratically. Put the sampling bottle on the magnetic stirrer. Turn on the stirrer. Record Data: Grape Juice and Yeast Press the Start key on the GLX. Record data for 30 minutes and then stop. Carefully remove the CO2 Gas Sensor from the sampling bottle. Dispose of the contents as directed and rinse the inside of the bottle. Record Data: Grape Juice, Yeast, and Inhibitor Transfer another 150 mL of warm grape juice to the sampling bottle and add 1.0 g of sodium fluoride. Stir the yeast suspension again and add 10 mL to the grape juice. Add a layer of mineral oil on top of the grape juice as before. Return the CO2 Gas Sensor to the sampling bottle so that the rubber stopper rests loosely in the end of the bottle. Press the Start key on the GLX, record data for 30 minutes and then stop. Carefully remove the CO2 Gas Sensor from the sampling bottle. Dispose of the contents as directed and rinse the inside of the bottle. Record Data: Warm Grape Juice and Yeast Disconnect the CO2 Gas Sensor and reconnect the Fast-Response Temperature Probe. Select Digits as before and put the end of the probe in the remaining grape juice. Use the hot plate to warm the grape juice to between 45 and 50ËÅ ¡C. Transfer the warmed grape juice to the sampling bottle. Stir the yeast suspension again and add 10 mL to the warmed grape juice. Add a layer of mineral oil on top of the grape juice as before. Disconnect the temperature probe and re-connect the CO2 Gas Sensor. Return the CO2 Gas Sensor to the sampling bottle so that the rubber stopper rests loosely in the end of the bottle. Press the Start key on the GLX, record data for 30 minutes and then stop. Carefully remove the CO2 Gas Sensor from the sampling bottle. Dispose of the contents as directed and rinse the inside of the bottle. How do your results compare with others in your class?
